This Privacy Policy explains how Rajesh Kumar Gaba, a sole proprietorship doing business as "KnowSeat" (SF, F-62, Flat No. 6, Siddhivinayak Apartments, Humayunpur Area Road, Humayunpur, Safdarjung Enclave, New Delhi, Delhi – 110029, India) ("KnowSeat", "we", "us"), collects, uses, shares and protects your personal data when you use the KnowSeat app and www.knowseat.com. We act as the Data Fiduciary for your personal data.
This policy is published in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act"), the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. We operate in India and process your data in accordance with Indian law.
1. Information we collect
1.1 Information you give us
- Account details: mobile number (verified by OTP), name and, optionally, email address and profile photo.
- Journey details: metro line, boarding and exit stations, and coach number.
- NCMC recharge (when launched): the card number you enter, used only to process the recharge. We keep only the last four digits.
- Support and feedback: messages, issue reports and attachments you send us.
1.2 Information collected automatically
- Location: precise location while you use seat features, to show seats in your coach and verify proximity. If you turn on seat alerts, location is also used in the background for up to one hour, only after you give explicit permission.
- Device and app data: device model, OS version, app version, push-notification token, crash and diagnostic logs.
1.3 Payment information
Payments are processed by Paytm Payment Gateway. We receive the order ID, amount, payment status, payment mode (for example, UPI or card) and gateway transaction ID. We never receive or store your full card number, CVV, UPI PIN or net-banking credentials.
2. How we use your information
- To create and secure your account and verify your identity.
- To show seats that are freeing up in your coach, match seat requests, and verify handovers.
- To process payments, refunds and reward points, and to prevent fraud.
- To send service notifications, such as seat alerts and payment confirmations.
- To respond to support requests and grievances.
- To improve reliability and performance using aggregated or de-identified data.
- To comply with legal obligations.
We process your personal data on the basis of your consent and, where permitted by the DPDP Act, for legitimate uses such as providing a service you asked for or complying with law. We do not use your data for automated decisions that have legal effects on you.
3. Sharing and third-party disclosure
We do not sell or rent your personal data. We share it only as follows:
- Other commuters: when you take part in a swap, the other commuter sees your first name, coach, seat and exit station — never your phone number.
- Service providers (Data Processors): Google Firebase / Google Cloud (authentication, database, cloud functions, notifications, crash reporting) and Paytm Payment Gateway (payments and refunds). They process data only on our instructions.
- ONDC network (when metro tickets launch): the details needed to issue your ticket, such as name, phone number and journey, are shared with the ticket-issuing seller on the ONDC network.
- Legal requirements: with courts, law enforcement or regulators when required by law, or to protect the rights and safety of users and KnowSeat.
4. How we protect your information
- All data is encrypted in transit (HTTPS/TLS) and at rest on Google Cloud infrastructure.
- Access is restricted by authentication and database security rules; only authorised personnel can access personal data.
- Payment pages are hosted by Paytm; payment requests and responses are signed with checksums.
- If a personal data breach happens, we will notify affected users and the Data Protection Board of India as required by the DPDP Act.
5. Data retention
We keep personal data only as long as your account is active or as needed for the purposes above. Location updates are kept only while a seat offer or request is active. Payment records are kept for the period required by tax and accounting laws (usually up to 8 years). When you delete your account, we delete or anonymise your personal data within 30 days, except where the law requires us to keep it.
6. Your rights
Under the DPDP Act and applicable Indian law, you have the right to:
